INEZ – A settlement has been reached in the Martin Circuit Court case filed by Zachary Todd of Inez who alleged injuries in a vehicle accident that occurred on June 4, 2008 at the intersection of Kentucky routes 3 and 645 at Middle Fork.
According to Todd's complaint, filed by Kirk & Crum, PLLC on February 17, 2009, he received "severe injuries" when his car hit an oil-slickened spot causing him to "lose control" of his car and "flip off the roadway."
Todd claimed that prior to his accident, another vehicle owned by defendant, Schlumberger and operated by Michael McCoy, became damaged when it "struck road debris that caused the vehicle (a large truck) to leak hydraulic fluid on to the road" and that Schlumberger failed to clean the oil from the roadway, thereby leaving a "dangerous condition" even though defendants "owed a duty to use care toward plaintiff and the traveling public" and that the defendant was "negligent" in not removing the material from the road.
Schlumberger, represented by Paintsville attorney Don Jones, defended Todd's allegations and denied liability in its court filings.
Todd was represented by Jeffrey Hinkle and Kyle Salyer.
