Who Can File a Wrongful Death Suit in Kentucky?

- If the decedent had no spouse and no children, his or her parent/parents would receive all damages.
- If the decedent had no spouse, children, or parents, the damages would go toward his or her estate.
Wrongful Death Statute of Limitations
In Kentucky, there is a one-year limit on the filing of a wrongful death claim. A claim must be filed within one year of the person’s death or within one year of the appointment of a personal representative to the decedent’s estate.
